The team at The Mom Box understands that terms and conditions can be lengthy. However, we want our subscribers and customers to fully understand our policies so that receiving and enjoying The Mom Box remains a positive, supportive, and rewarding experience.
Please read these Terms of Service (βTermsβ) carefully before accessing or using www.themomboxfit.com and any associated website, customer account, subscription service, digital resource, product, feature, content, or service operated by The Mom Box. Collectively, these are referred to in these Terms as the βSiteβ or βService.β
The Service is operated by The Mom Box (βThe Mom Box,β βwe,β βus,β or βourβ), a Canadian subscription box business.
By accessing the Site, creating an account, purchasing a product, subscribing to The Mom Box, downloading or using our digital resources, or otherwise using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

Nothing in these Terms is intended to limit, waive, exclude, or replace any rights or remedies that cannot legally be limited or excluded under applicable Canadian federal, provincial, or territorial consumer protection legislation.

The contents of each box may vary. Products may contain ingredients or materials that could cause an allergic reaction, sensitivity, intolerance, irritation, or other adverse response.

Product ingredients, formulations, packaging, labels, and manufacturing processes may change without notice. Subscribers should always rely on the information printed on the productβs current packaging rather than information contained in previous boxes, photographs, advertisements, social-media posts, or product descriptions.
The Mom Box and its owners, directors, officers, employees, contractors, representatives, and suppliers are not responsible for an allergic reaction, sensitivity, intolerance, injury, illness, loss, or other adverse response resulting from the use, misuse, consumption, storage, handling, or application of a product, except to the extent that liability cannot legally be excluded under applicable law.
Medical, Nutritional and Fitness Disclaimer
The Site, subscription boxes, meal plans, recipes, workout plans, fitness suggestions, wellness information, product descriptions, social-media content, emails, downloadable materials, and other resources offered by The Mom Box are provided for general informational and educational purposes only.
They are not intended to constitute or replace medical advice, medical treatment, diagnosis, nutritional counselling, mental-health care, physiotherapy, rehabilitation, personal training, or advice from a qualified healthcare professional.
The Mom Box does not make any representation that a product, meal plan, recipe, workout, wellness practice, or other resource is appropriate or safe for every person.
Before beginning a new workout program, changing your diet, taking a supplement, or using a wellness product, you should consult an appropriately qualified healthcare professional, particularly if you:

Results from fitness, nutrition, or wellness resources will vary. The Mom Box does not guarantee weight loss, muscle gain, improved health, improved fitness, increased energy, or any other particular result.
3. Subscriptions, Billing and Cancellations
Initial Billing and Automatic Renewals
All new subscriptions are billed immediately when the subscription order is completed, unless a different billing arrangement is clearly disclosed at checkout.
Following the initial charge, monthly subscriptions will automatically renew and be billed on the 28th day of each month, unless the subscription is cancelled before the applicable cancellation deadline or a different renewal date is clearly identified during checkout.
By purchasing an automatically renewing subscription, you authorize The Mom Box and its third-party payment processor to charge the payment method associated with your account for:
Your subscription will continue to renew until it is cancelled in accordance with these Terms.
The exact subscription price, billing frequency, products or services included, shipping charges, and applicable taxes will be displayed before you complete your purchase.
Currency
Unless otherwise expressly stated, all prices, subscription fees, shipping charges, credits, and refunds displayed on the Site are stated and processed in Canadian dollars (CAD).
Your financial institution or payment provider may impose additional fees in connection with your transaction. The Mom Box does not control and is not responsible for fees charged directly by your financial institution or payment provider.
Changes to Subscription Pricing
We may change the price of a subscription, shipping charge, or included service from time to time.
Where required by applicable law, we will provide advance notice of a material change before the new price is charged. The notice may be provided through email, the Site, your customer account, or another reasonable method.
By continuing your subscription after the effective date of the disclosed change, you agree to the new price. You may cancel your subscription before the change takes effect if you do not wish to accept it.
Cancellation Policy
You may cancel your subscription at any time.
To prevent the next scheduled renewal charge, your cancellation request must be completed or received at least 48 hours before the next scheduled renewal date, which is generally the 28th day of the month.

A cancellation is effective only when it has been successfully submitted through the customer account or received by The Mom Box. We may send a confirmation of cancellation by email. You should retain the cancellation confirmation for your records.
If your cancellation request is received after the cancellation deadline and the next subscription payment has already been processed, the cancellation will normally apply to the following renewal period.
This cancellation policy does not limit any additional cancellation right or cooling-off period available to you under applicable federal, provincial, or territorial consumer protection legislation.
No Prorated Subscription Refunds
Except where required by applicable law or expressly stated in these Terms, cancelling a subscription does not entitle you to a prorated refund for any part of a subscription period that has already been billed.
If a subscription box has already been processed, prepared, packed, or shipped before a cancellation is received, that box may still be delivered and the related charge may remain payable.
Failed Payments
If we are unable to process a subscription payment, we or our payment processor may attempt to process the payment again.
We may pause or cancel a subscription where payment cannot be completed. You remain responsible for valid charges incurred before the subscription is paused or cancelled.
You are responsible for keeping your payment method, billing information, shipping address, and contact information current.
Subscription Availability
Subscription availability may be limited. We reserve the right to limit the number of subscriptions available, establish waiting lists, suspend new subscriptions, or discontinue a subscription plan.
If we discontinue a prepaid subscription before all prepaid boxes have been supplied, we will provide an appropriate refund or credit for any affected undelivered period, subject to applicable law.
4. Taxes and Orders
Canadian Customers
The Mom Box is a Canadian business. Unless otherwise disclosed, orders are processed and shipped from within Canada.

We will not add undisclosed mandatory charges after you have agreed to the purchase. Government-imposed sales taxes may be calculated and displayed during checkout.
International Orders
The Mom Box may choose to offer shipping outside Canada to certain destinations. International shipping availability will be displayed during checkout.
International customers are responsible for ensuring that ordered products may legally be imported into and used in their destination country.
International orders may be subject to customs charges, import duties, taxes, brokerage fees, handling charges, or other government or carrier-imposed fees. Unless expressly stated otherwise at checkout, these amounts are not included in the purchase price and are the customerβs responsibility.
The Mom Box does not control customs processing and cannot guarantee that an international shipment will not be delayed, opened, inspected, refused, or assessed additional fees.
If an international shipment is rejected, refused, abandoned, or returned because the customer failed to pay applicable import charges or comply with local import requirements, any refund will be determined after deducting non-refundable shipping expenses, return expenses, duties, fees, or other costs incurred by The Mom Box, to the extent permitted by law.

Product availability may change because of supplier shortages, manufacturing delays, shipping delays, discontinued products, safety concerns, or circumstances outside our reasonable control.
We may replace an unavailable product with another product that we reasonably consider to have a similar purpose or retail value. Colours, flavours, scents, sizes, packaging, brands, or product varieties may differ between boxes.
Where a specific product is essential to a particular purchase, this will be stated in the applicable product or subscription description.

6. Shipping, Delivery, Damages and Refund Policy
Shipping and Delivery
Orders are shipped through independent third-party carriers.
Shipping methods, estimated delivery periods, and shipping charges will be displayed during checkout or otherwise communicated to the customer.
Delivery dates are estimates only and are not guaranteed. Delivery may be affected by weather, carrier delays, labour disruptions, customs processing, address errors, supply interruptions, natural disasters, or other circumstances outside our reasonable control.
The Mom Box is not responsible for delays caused solely by a third-party carrier or circumstances beyond our reasonable control. However, nothing in these Terms limits any delivery right or remedy that cannot legally be excluded under applicable consumer protection legislation.
Customers are responsible for providing a complete and accurate shipping address before an order is processed.
If an order is returned because an address was incorrect, incomplete, inaccessible, or no longer current, the customer may be responsible for reasonable reshipping charges, except where the error was caused by The Mom Box.
You must update your shipping address before the applicable monthly processing deadline. Updating your address after a box has been processed or shipped may not redirect that shipment.
Lost, Missing or Misdelivered Shipments
A shipment shown as delivered by the carrier but not received should be reported to us as soon as reasonably possible.

Missing products, damaged products, or damaged shipments must be reported within 30 days of the shipping dateor within another period required by applicable law.

Exterior Packaging
Minor dents, scratches, creases, tears, scuffs, markings, or other cosmetic damage to exterior shipping packaging do not necessarily indicate that the products inside are damaged.
A replacement or refund will not normally be issued solely because the exterior shipping box or a productβs retail packaging has minor cosmetic damage, provided the product remains complete, safe, functional, sealed where applicable, and suitable for its intended use.
This does not apply where the packaging damage makes the product unsafe, contaminated, unusable, incomplete, or materially different from what was purchased.
Replacements
Where an included product is confirmed to be missing, defective, unsafe, or materially damaged, we may provide:

Returns
Because The Mom Box may contain food, beverages, supplements, cosmetics, skincare products, personal-care products, hygiene-related items, or other products that cannot safely be restocked after delivery, returns may not be accepted for change-of-mind reasons.
Products must not be returned without prior authorization from The Mom Box.
Unauthorized returns may be refused or may not qualify for a refund.
This return limitation does not apply to defective, unsafe, incorrectly supplied, misrepresented, or damaged products where a return, refund, repair, replacement, or other remedy is required under applicable law.
Refunds
Except where required by law, refunds are assessed according to the circumstances of the request.
Approved refunds will normally be issued to the original payment method. Processing times may vary depending on the payment provider or financial institution.
Original shipping charges may be non-refundable where an order was correctly fulfilled and delivered.
The Mom Box will not deny a refund, cancellation, replacement, or other remedy where that remedy is required under applicable Canadian federal, provincial, or territorial law.
Digital Products
Meal plans, workout plans, recipes, guides, downloadable files, links, videos, and other digital resources may be provided as part of a subscription or separate purchase.
Digital resources are licensed for the customerβs personal, non-commercial use only.
Except where required by law, digital resources that have already been delivered, downloaded, accessed, or made available may be non-refundable.
7. User Accounts
When creating an account, you must provide information that is accurate, complete, and current.
Failure to provide accurate information, or maintaining information that is materially false, outdated, or incomplete, may constitute a breach of these Terms and may result in an account, purchase, or subscription being suspended or terminated.

These materials are protected by Canadian and international copyright, trademark, and other intellectual-property laws.
The name The Mom Box, its logos, slogans, designs, and other brand elements may not be copied, reproduced, modified, displayed, distributed, used, or associated with another product, service, business, website, or social-media account without our prior written consent.
Subject to these Terms, The Mom Box grants customers a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use purchased or subscription-based digital materials for personal and non-commercial purposes.

Your use of a third-party website or service is governed by that third partyβs own terms, policies, and practices.
